Ok so the CO says no overnight guests while kids are present. My ex is clearly having someone sleep over at her house on "my" days with the kids (our 10yo daughter told me). I don't want to be that guy who files a modification, but this feels like she's being deliberately disrespectful. Do I need to document this? Is it worth bringing up or am I overreacting?
That's a violation and you need to document it. Keep a log with dates, names if you know them, and anything the kids tell you about it. You'll need that if this goes back to court.
This is so frustrating. I dealt with something similar and learned that you basically have to go back to court to actually enforce custody violations. The system sucks but document everything just in case.
Ugh this sucks. Have you tried just calling her out on it directly first or did you want to go straight to enforcing it? Sometimes a 'hey I know about this' text is enough to make people stop.
The custody order is pretty clear on this. If she's consistently violating it you might need to contact your lawyer about filing a motion to enforce. Don't let it slide or she'll think she can keep ignoring the CO.
How old are your kids? That actually matters for how serious the court will take the overnight guest issue. And have the kids mentioned anything to you about it?
